ATLGBTQ Privacy Policy

These terms apply to your use of the ATLGBTQ website at https://www.atlgbtq.com and the ATLGBTQ Hubs mobile app (together, the “Service”), run by ATLGBTQ Co. LTD (“ATLGBTQ”, “we”, “us”, “our”). By using the Service you agree to these terms. If you do not agree, please do not use it. Our Privacy Policy, at https://www.atlgbtq.com/privacy-policy/, explains how we handle your information.

1. Who can use ATLGBTQ

You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian should agree to these terms for you. Some events listed in ATLGBTQ may be limited to adults, such as 18+ or 21+ events. Those limits are set by the organizers and venues, and you are responsible for following them.

2. What ATLGBTQ is

ATLGBTQ was founded in 2015 to recognize and celebrate Atlanta’s leaders in the LGBTQ+ community and to help preserve LGBTQ+ culture in Atlanta. Our website promotes community members and their work, across creativity, business, spirituality, health and well-being, philanthropy, politics, and the advancement of LGBTQ+ people of color. Our app helps you discover LGBTQ+ events, Hubs, organizations, talent, sponsors, and vendors, and plan your time. We do not run most of the events listed. Each event is run by its own organizer.

3. Event information

• Event details, times, places, lineups, and prices are provided by organizers and can change or be wrong. Please confirm with the organizer before you travel or buy a ticket.
• We do not guarantee that any event will happen, be safe, be accessible, or be as described.
• ATLGBTQ is a platform that connects creators with the people who enjoy their work. We do not own, run, or partner with the events listed unless a listing says so. Our Event Disclaimer, at https://www.atlgbtq.com/disclaimer/, explains this in full.
• You attend events at your own choice and risk. Any agreement between you and an organizer, venue, sponsor, or vendor is between you and them, not us.

4. Your account

• Browsing needs no account. You need one to save a schedule, follow Hubs, or save contacts.
• Give accurate information and keep your password private. You are responsible for activity on your account. Tell us at support@atlgbtq.com if you think someone else has used it.
• You can delete your app account at any time under Account > Delete account. This permanently deletes your account, schedule, followed Hubs, and saved contacts.

5. Your saved contacts

The contacts feature is a private notebook. Only save details of people you have met, and use them only for reasonable, personal follow-up. Do not use saved contacts to harass anyone or to send spam. You are responsible for the information you enter about other people.

6. Acceptable use

Please do not:

• break the law or use the Service to harm, harass, threaten, or discriminate against anyone;
• try to get into accounts, systems, or data that are not yours, or interfere with how the Service works;
• scrape, copy, or resell our content at scale, or use bots or automated tools without our written permission;
• submit false, misleading, or infringing information; or
• use the Service to send spam or advertise things unrelated to the events and community work listed.

We may limit or end access for anyone who breaks these rules.

7. Event and organization submissions

Organizers and community members can submit events, organizations, and their work through our forms. When you submit:

• You confirm that you have the right to use the text, images, logos, and names you submit, and you check a required box on the form saying so.
• You give us a free, worldwide, non-exclusive right to use, display, edit for format, and share what you submit in the app, on the website, and in our promotion of your event, organization, or work, for as long as it is listed.
• You are responsible for what you submit. We may review, edit, reject, or remove submissions at any time.
• Please do not submit anything you do not have the right to share, including other people’s photos, logos, or private details.

8. Copyright and takedowns

We respect other people’s rights. If you believe something in ATLGBTQ infringes your copyright, trademark, or other rights, or shows you or your information without your permission, email contact@atlgbtq.com with:

• what the content is and where you see it;
• why you believe it infringes or should be removed; and
• your name and how to reach you.

We review requests promptly and remove content that should not be there. We may end access for people who repeatedly infringe the rights of others.

9. Our content and your license

The ATLGBTQ name, logo, design, and the way the Service is put together belong to ATLGBTQ Co. LTD or our licensors. Event and community content belongs to the organizers, members, and other owners. We give you a personal, limited, non-exclusive, non-transferable license to use the app and website for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, or resell the Service except as the law allows.

10. Purchases from our website

If you buy something from our website:

• Prices, availability, and descriptions are shown at checkout.
• Payment is handled by our payment providers, and we do not store your full card number.
• Refunds and cancellations follow the policy shown on the product or at checkout.
• Tickets or purchases for events run by others may be sold by those organizers under their own terms.

11. Links to other sites

The Service links to websites and services we do not run, such as organizers, sponsors, vendors, community members, social media, maps, and email. We are not responsible for them. Their terms and privacy policies apply when you use them.

12. If you downloaded the app from Apple

• These terms are between you and us, not Apple. Apple has no duty to provide support or maintenance for the app.
• If the app does not meet any warranty that applies, you may tell Apple, and Apple may refund the purchase price, if any. Apple has no other warranty duty for the app.
• Apple is not responsible for claims about the app, including product liability claims, legal compliance claims, or intellectual-property claims. We are responsible for those.
• You confirm that you are not in a country under a US embargo and not on a US government restricted list.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• Use of the app must follow the Apple Media Services terms.

13. Ending your access

You can stop using the Service at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the Service. Sections that should survive ending, such as those about content, disclaimers, liability, and disputes, will survive.

14. Disclaimers

The Service is provided “as is” and “as available.” To the extent the law allows, we do not promise that it will be accurate, always available, secure, or free of errors. We are not responsible for events, organizers, venues, vendors, community members, or other users.

15. Limits on our liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service or from any event you attend. Our total liability to you for any claim is limited to the greater of $100 or the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

16. Indemnity

You agree to protect us from claims, losses, and costs that come from your misuse of the Service, content you submit, or your breach of these terms, to the extent the law allows.

17. Changes to these terms

We may update these terms. We will post the new version with a new effective date and tell you in the app or by email if the changes are significant. If you keep using the Service after a change, you accept the new terms.
